1.2. By accessing, browsing or using the Website in any manner, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy and any other legal notices or policies published on the Website (collectively, the “Agreement”).

2.2. FOGO Real Estate is a real estate brokerage and consultancy based in Dubai, United Arab Emirates, providing services relating to real estate investment, property acquisition and other property-related opportunities in Dubai and, where applicable, international markets.
2.3. The Website is provided for general information, marketing and communication purposes only. Unless expressly stated in a separate written agreement signed by FOGO Real Estate, nothing contained on the Website constitutes a binding offer, financial advice, investment advice, legal advice, tax advice or any other form of professional advice.
3.1. We may amend or update these Terms from time to time to reflect changes in applicable law, regulatory requirements, our business activities, our services or the functionality of the Website.

8.2. Although we endeavour to provide accurate and current information, Content may contain inaccuracies, omissions, typographical errors or information that becomes outdated.
8.3. Certain Content may be supplied by developers, property owners, sellers, landlords, agents, marketing partners or other third parties. Such information may not always be independently verified by FOGO Real Estate.
8.4. Nothing on the Website constitutes:

9.5. To the maximum extent permitted by law, FOGO Real Estate shall not be responsible for losses arising solely from reliance on inaccurate, incomplete, outdated or third-party property information displayed on the Website.

(a) access and view the Website and Content for personal, informational and non-commercial purposes; and
(b) print or download a reasonable and limited number of Website pages for personal reference, provided that copyright, trademark and proprietary notices are not removed or altered.
11.4. Without our prior written consent, you must not:
(a) reproduce, copy, modify, adapt, translate, republish, distribute, transmit, sell, license, commercially exploit or otherwise reuse Website Content;

13.1. Property photographs, architectural images, videos, renderings, project visuals, event photographs and similar media may be used on the Website for legitimate marketing, informational and brand communication purposes, subject to applicable law and required permissions.
13.2. You may not reproduce, download for commercial reuse, republish, distribute or use FOGO Real Estate images, videos, renderings, designs or other brand assets in listings, advertising, social media, websites, marketing campaigns or other commercial materials without prior written permission.
13.3. Unauthorised use of intellectual property or brand assets may result in enforcement action and any remedies available under applicable law.
14.1. To the maximum extent permitted by applicable law, the Website and Content are provided on an “as is” and “as available” basis.
14.2. We make no representation or warranty that:
(a) the Website or Content will always be accurate, complete, current or free from errors or omissions;
(b) access to the Website will always be uninterrupted, secure or free from bugs, viruses or harmful components;
(c) the Website will meet your individual requirements or expectations;
(d) any particular investment return, property value, rental yield, financial result or other outcome will result from accessing the Website or acting upon its Content.
14.3. To the extent permitted by applicable law, all warranties, representations and conditions that might otherwise be implied by law are excluded.

(a) indirect, incidental, special, consequential or punitive loss or damage;
(b) loss of profit, revenue, business, anticipated savings, opportunity, goodwill or data;
(c) loss or damage arising from:
(i) reliance on Website Content;
(ii) inaccurate, incomplete or outdated pricing, property information or availability;
(iii) delays, interruptions, technical errors or unavailability of the Website;
(iv) viruses, malicious software, cybersecurity incidents or harmful material introduced by third parties;
(v) acts or omissions of property developers, sellers, owners, landlords, tenants, brokers, contractors, financial institutions or other third parties;
(vi) changes in market conditions, legislation, governmental policies, developer policies, property values, exchange rates or other matters outside our reasonable control.
15.3. Any limitation of liability contained in these Terms applies only to the extent permitted by applicable law and does not affect any statutory or mandatory rights that cannot legally be waived or restricted.
16.1. To the extent permitted by applicable law, you agree to indemnify and hold harmless FOGO Real Estate, its shareholders, directors, employees, representatives, agents and affiliates from claims, liabilities, damages, losses, costs and reasonable legal expenses arising from:
(a) your unlawful or unauthorised use of the Website;
(b) your material breach of these Terms;
(c) User Content submitted by you in breach of these Terms;
(d) your infringement of a third party’s intellectual property, privacy or other legal rights.
16.2. Where legally permitted, we reserve the right to assume the defence and control of any matter subject to indemnification, and you agree to provide reasonable cooperation in connection with such defence.
17.1. These Terms and any dispute, controversy or claim arising out of or in connection with them, the Website or your use of the Website, including non-contractual disputes or claims, shall be governed by and construed in accordance with the applicable laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.
17.2. Subject to any mandatory provisions of applicable law, the courts of Dubai shall have jurisdiction over disputes arising out of or relating to these Terms or the Website.
18.1. To the extent permitted by applicable UAE law, communications, agreements, notices and records maintained or transmitted electronically may have the same validity and enforceability as equivalent written records.
18.2. By providing your contact details to us, you acknowledge that communications relating to your enquiry, requested services or business relationship may be sent electronically, including by email, telephone, SMS, WhatsApp or Website-based communication.
18.3. Marketing communications will be sent subject to applicable law and, where required, your consent or another lawful basis.
19.1. If any provision of these Terms is determined by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be modified or removed only to the minimum extent necessary.
19.2. The validity and enforceability of all remaining provisions shall not be affected.
20.1. FOGO Real Estate may assign, transfer or subcontract its rights or obligations under these Terms to an affiliate, successor or third party where permitted by law.
20.2. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
21.1. These Terms, together with the Privacy Policy and any other legal notices or policies expressly incorporated into them, constitute the agreement between you and FOGO Real Estate concerning your use of the Website.
21.2. These Terms supersede prior representations or understandings relating specifically to your access to and use of the Website, except where otherwise agreed in a separate written contract.
